SIU Set to Strike: Minister Warns Fraudulent Lawyers in R30bn Medico-Legal Claims Probe

Legal practitioners who have been submitting fraudulent negligence claims worth millions of rands over the years have just two weeks to withdraw their claims or face the full force of the Special Investigations Unit (SIU) and the National Prosecuting Authority (NPA). 
 

Unscrupulous lawyers, often collaborating with healthcare practitioners, have lodged billions of rands in fraudulent medico-legal claims against South Africa's Health Department. 
 
During a briefing last weekend, Health Minister Dr. Aaron Motsoaledi and SIU head Andy Mothibi revealed preliminary findings of an SIU investigation into these claims. 
 
Over R100 billion in claims has been made against provincial Health Departments, with KwaZulu-Natal leading at R29 billion, followed by Gauteng at R24 billion, and the Eastern Cape at R22.3 billion. More than R30 billion of these claims is under SIU investigation.
 
In KwaZulu-Natal, 107 investigations totalling R2.416 billion have been completed, with R1.7 billion of these claims involving deceased individuals; in the Eastern Cape, 23 letters of demand totaling R298 million were investigated, with R271.8 million found to be fraudulent. 

Gauteng has 2,450 medico-legal claims, with 611 under investigation, valued at R4.175 billion; 58 cases have been finalized, saving the province R66 million. In particular Nonxuba Attorneys, a Johannesburg-based law firm, is accused of submitting nearly R500 million in fraudulent claims, often inventing cases or stealing medical records. 

 
The SIU has referred several cases to the NPA and the Legal Practice Council for further action. 
 
Health Minister Aaron Motsoaledi warned that legal practitioners who do not withdraw their claims will face prosecution. The investigation continues, with the potential for uncovering more fraudulent claims.
