1.  GENERAL NOTICE AND PURPOSE

1.1	Thank you for reading the Acceptable Use Policy (“AUP”) of iCognition t/a VisualLive CK 1999/051172/23 (“VisualLive)”). VisualLive’s eLecture Platform Service primarily consists of the VLearn eLecture platform and related services such as system related emails.
1.2	The Medical Education Network ( MedED) resides  on the eLecture platform and is  wholly owned by VisualLive
1.3	By accessing this website, or by contracting with us for The Medical Education Network (MedED)’s eLecture Platform Service (“service”), you agree, without limitation or  qualification, to be bound by this policy and the terms and conditions it contains, as well  as any other additional terms, conditions, rules or policies which are displayed to you in connection with this service/website.
1.4	Please check this AUP periodically for changes. We reserve the right, at our discretion, to  update or revise this AUP at any time, with or without notice.
1.5	The purpose of this AUP is to comply with the relevant laws of the Republic; to specify to  customers and users of our service/website what activities and online behaviour are considered an unacceptable use of the service/website; to protect the integrity of our network and to specify the consequences that may flow from undertaking such prohibited activities. This document contains a number of legal obligations which you are presumed to be familiar.
1.6	Should the AUP not be adhered to, The Medical Education Network (MedED) may  discontinue or alter any service level or aspect of the service at any time, without notice, without liability and at The Medical Education Network (MedED)’s sole discretion. The Medical Education Network (MedED) reserves the right, in its sole discretion, to  terminate your access to all or part of this site, with or without notice.

 

2.  RULES OF USER CONDUCT

2.1	By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to you on or through this site, you agree that you will not upload, post, or otherwise distribute or facilitate distribution of any content -- including text, communications, software, images, sounds, data, or other information -- that:
	•   is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals);
	•  victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
	•  infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;
	•  constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (also known as "Spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
	•  contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or obtain unauthorized access to any data or other information of any third party; or
	•  impersonates any person or entity, including any employee or representative of The Medical Education Network.
2.2	The Medical Education Network (MedED) does not always pre-screen or monitor the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this site.
2.3	The Medical Education Network (MedED) and its agents have the right at their sole discretion to remove any content that, in The Medical Education Network’s judgment, does not comply with the this AUP or is otherwise harmful, objectionable, or inaccurate within a reasonable time.

 

3.  THIRD PARTY SITES

3.1

This site may produce automated search results or otherwise link you to other sites on the Internet. These other sites are not under the control of The Medical Education Network (MedED), and you acknowledge that The Medical Education Network (MedED) is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. The inclusion of such a link does not imply endorsement of the site by The Medical Education Network (MedED) or any association with its operators.

3.2

Access to public Internet spaces, such as bulletin boards, Usenet groups, chat rooms and moderated forums is entirely voluntary and at your own risk.

 

4.  COPYRIGHTS

4.1	By accessing this site you acknowledge that all content and materials available on this site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by The Medical Education Network (MedED), you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content.
4.2	Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from The Medical Education Network (MedED) is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in this AUP is prohibited.
4.3	As noted above, reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this site is strictly prohibited without the express written permission of the The Medical Education Network (MedED).

 

5.  INDEMNIFICATION

Upon a request, you agree to defend, indemnify, and hold harmless The Medical Education Network (MedED) and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees that arise from your misuse of this site.
 

6.  INTERNATIONAL USE

The Medical Education Network (MedED) makes no representation that materials on this site are appropriate or available for use in locations outside South Africa, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
 

7.  JURISDICTION

This AUP shall be governed by and construed in accordance with the laws of South Africa and the parties submit to the exclusive jurisdiction of the South African Courts. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this AUP or your use of this site shall be filed only in the courts of South Africa.
 

8.  WHOLE AGREEMENT

8.1	Unless otherwise specified herein, this agreement constitutes the entire agreement between you and The Medical Education Network (MedED) with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and The Medical Education Network (MedED) with respect to this site.
8.2	If any part of this AUP is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

2.1	The Medical Education Network (MedED) recognises the importance of its users’ privacy and takes steps to protect their privacy. This policy discloses the privacy practises for all products, sites and services of The Medical Education Network (MedED).
2.2	By visiting The Medical Education Network (MedED)’s eLecture Platform/websites or using any of our services, you acknowledge that you accept the practises and policies outlined in this Privacy Statement.
	What this Privacy Policy covers  This Privacy Statement covers The Medical Education Network (MedED)’s treatment of personally identifiable information (“personal information”) that The Medical Education Network (MedED)’s eLecture Platform gathers when you access the eLecture Platform sites   controlled/owned by Visual Live (collectively “VisualLive’s eLecture Platform sites”)
	What this Privacy Policy does not cover In some instances, The Medical Education Network (MedED) merely provides a platform through which content can be uploaded/made available and through which content can viewed and used by its users. In these instances, the sites/services are not controlled/owned by The Medical Education Network (MedED). The Medical Education Network (MedED) has no access to or control over them or their content. In these instances, the data collected through the use of such sites is controlled by the clients and is governed by the privacy policy of the entity/person who controls/owns such site, and not by Visual Live.
