General Notice and Purpose

Thank you for reading the Acceptable Use Policy (“AUP”) of iCognition t/a The Medical Education Network CK 1999/051172/23 (“MedED”). The Medical Education Network’s Platform Service primarily consists of the eLecture platform and related services such as system-related emails.

The Medical Education Network (MedED) is wholly owned by iCognition CK.

By accessing this website, or by contracting with us for The Medical Education Network (MedED)’s eLecture Platform Service (“service”), you agree, without limitation or qualification, to be bound by this policy and the terms and conditions it contains, as well as any other additional terms, conditions, rules or policies which are displayed to you in connection with this service/website.

Please check this AUP periodically for changes. We reserve the right, at our discretion, to update or revise this AUP at any time, with or without notice.

The purpose of this AUP is to comply with the relevant laws of the Republic; to specify to customers and users of our service/website what activities and online behaviour are considered an unacceptable use of the service/website; to protect the integrity of our network; and to specify the consequences that may flow from undertaking such prohibited activities.

Important: Should the AUP not be adhered to, The Medical Education Network (MedED) may discontinue or alter any service level or aspect of the service at any time, without notice, without liability and at MedED’s sole discretion.   • Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or obtain unauthorised access to any data or other information of any third party
  • Impersonates any person or entity, including any employee or representative of The Medical Education Network

The Medical Education Network (MedED) does not always pre-screen or monitor the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available on or through this site.

The Medical Education Network (MedED) and its agents have the right at their sole discretion to remove any content that does not comply with this AUP or is otherwise harmful, objectionable, or inaccurate within a reasonable time.

Upon a request, you agree to defend, indemnify, and hold harmless The Medical Education Network (MedED) and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees that arise from your misuse of this site.

International Use

The Medical Education Network (MedED) makes no representation that materials on this site are appropriate or available for use in locations outside South Africa, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.

Jurisdiction

This AUP shall be governed by and construed in accordance with the laws of South Africa and the parties submit to the exclusive jurisdiction of the South African Courts. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this AUP or your use of this site shall be filed only in the courts of South Africa.

Whole Agreement

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and The Medical Education Network (MedED) with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and The Medical Education Network (MedED) with respect to this site.

If any part of this AUP is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
